This CAPED event brings to a central location in California AHEAD’s most experienced, legal-training team: Mary Lee Vance, Ph.D., Jamie Axelrod, M.S., and Paul Grossman, JD. as well as guest-presenter, self-evaluation expert, Tom Thompson. This two-day course will draw from the best elements of the team’s multiple, introductory and advanced-level appearances for AHEAD.

No DSS office can function without the support of administrators and faculty. Hence the course will begin by modeling how to “sell” the DSS function in its broader philosophical, historical, and legal, universal design/civil rights context.

Focussing directly on the law, this training will give DSS professionals, house counsel, and ADA coordinators a comprehensive introduction to postsecondary student disability law, including the requirements of the Americans Disabilities Act, Section 504 of the Rehabilitation Act of 1973, and the Fair Housing Act.

There is simple no way to anticipate every question or scenario that will arise in implementing these laws. Consequently, the primary mission of this workshop will be to provide each participant with a series of comprehensive frameworks, “analytical paradigms,” and procedural tools for addressing the broad range of legal questions DSS officers and student affairs administrations are likely to encounter.

The courts and the Office for Civil Rights often devote more scrutiny to the processes colleges and universities use to reach their decisions than to the decisions themselves. Accordingly, towards the end of the first day, this course will include several presentations concerning the procedures most likely to receive agency approval and deference.

On day two, our presenters will examine how to apply these paradigms, processes, and procedures to difficult but common topics that arise in the application of disability law in a postsecondary setting. Specific topics will include:

Service animals and ESAs
Internships and field work palcements
Self-injurious students
Discipline of students with disabilities
Digital equality
Responding to sexual violence
